An Approval Pathway Assessment will be required in order to whether the subdivision can be approved as CDC or not. In the case of applications under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (Codes SEPP); Low Rise Housing Diversity Code& Subdivisions Code, determination of the application is subject to the permissibility requirements set out within the relevant applicable Local Environmental Plan (LEP) at the time of the certificate being issued. LEPs are known to change from time to time and this may result in an application under the Codes SEPP no longer being possible. Should LEP requirements change to restrict a CDC from being issued prior to the determination of the application we will not be able to issue the CDC.
